Terms of Service

These Terms of Service ("Terms") govern your access to and use of GenShot Studio, including website access, account tools, billing, usage entitlements, image-generation workflows, and generated outputs.

By accessing or using GenShot Studio, you agree to these Terms. If you do not agree, you must not use the Service.

Certain features, usage rights, and commercial permissions may depend on your plan, usage entitlements, or a separate written commercial agreement.

You must be at least 18 years old to use GenShot Studio.

You agree to provide accurate, current information when creating and maintaining your account, and to keep that information updated.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account.

If you become aware of unauthorized access to your account, you must notify us promptly at legal@genshot.co.

GenShot Studio is an AI-powered platform for generating premium model-based fashion and ecommerce imagery from user-provided inputs.

Service capabilities may include account management, generation workflows, prompts and styling controls, model and scene configuration, presets, exports, and related tools.

We may add, modify, suspend, or remove features over time. Access to specific capabilities may vary by plan limits, region, availability, or commercial arrangement.

GenShot Studio may offer pilot packages, paid subscriptions, usage-based billing, outcome-based packages, and other commercial models. Available plans, limits, pricing, and feature access are described in-product, on the pricing page, or in any applicable order form.

Paid subscriptions may renew automatically unless cancelled before the next billing cycle. By purchasing a paid plan, you authorize us and our payment providers to charge applicable fees, taxes, and usage-based charges to your selected payment method.

Generation and approval activity may be measured through usage entitlements, approved image volume, or other commercially agreed limits. Enterprise packages may price approved final images rather than attempted generations.

Unless otherwise stated in the applicable plan terms or at the time of purchase:

• separately granted or purchased usage entitlements follow the terms presented at purchase;
• subscription usage entitlements may reset at the end of the applicable subscription period;
• additional usage may be billed under the pricing model agreed for your plan.

You may cancel paid plans according to the cancellation flow and terms presented in your account, checkout flow, or any applicable order form. Cancellation generally stops future renewals. Current billing periods are generally not prorated unless required by applicable law or explicitly stated otherwise at the time of purchase.

Payments are generally non-refundable except where required by applicable law.

We may change pricing or plan structures from time to time. Where appropriate, material pricing changes will apply prospectively and we will provide reasonable advance notice before they take effect.

Payment processing is provided by Stripe.

"User Content" includes content and instructions you submit to the Service, such as product images, apparel item images, prompts, styling instructions, brand assets, reference images, workflow settings, and related materials.

You retain ownership of your User Content. You are responsible for ensuring you have all rights, licenses, and permissions necessary to upload, submit, and use that content.

You grant GenShot Studio a limited, non-exclusive license to host, store, reproduce, process, and transmit User Content solely as needed to operate, maintain, secure, and provide the Service to you.

You are responsible for the legality, accuracy, and appropriateness of your User Content and for ensuring that your inputs do not violate applicable law or third-party rights.

The Service generates images and related outputs based on your inputs, selected settings, prompts, and model behavior. Output quality and characteristics may vary.

Subject to these Terms, payment of applicable fees, and any plan-specific restrictions, you may use generated outputs created for your account in accordance with your plan and any applicable written commercial agreement.

Commercial usage permissions are plan-dependent. Outputs generated under trial or evaluation access may be limited to private review unless the applicable terms state otherwise. Outputs generated under paid packages or written commercial agreements may be used for personal or commercial purposes, subject to these Terms and any applicable written commercial agreement.

As between you and GenShot Studio, GenShot Studio does not claim ownership of outputs generated for your account, subject to these Terms, applicable plan restrictions, and any rights of third parties.

We do not guarantee that outputs are unique, exclusive, or unavailable to other users. Similar or identical outputs may be generated for other users.

You are responsible for reviewing outputs before publication, production, sale, advertising, or other commercial use, and for ensuring your use complies with applicable law, platform rules, and third-party rights.

You must not use GenShot Studio to:

• engage in unlawful activity or violate applicable laws or regulations;
• upload, generate, or distribute infringing, deceptive, abusive, fraudulent, or harmful content;
• misuse likenesses, impersonate individuals, or create misleading representations;
• upload content you do not have the right to use;
• reverse engineer, scrape, probe, or interfere with the Service or its underlying systems;
• bypass safeguards, rate limits, usage controls, access controls, or plan restrictions;
• use outputs in prohibited categories under applicable law or clearly communicated platform rules.

We may investigate suspected misuse and take action consistent with these Terms.

GenShot Studio retains all rights in the Service, including software, platform architecture, interface design, branding, and related materials.

Except as expressly stated in these Terms, no license or right is granted to use GenShot Studio intellectual property, trademarks, or brand assets.

You retain rights in your User Content. Rights and permissions regarding generated outputs are addressed in the section above.

AI-generated outputs may contain errors, inconsistencies, unrealistic details, or unexpected elements. Results may vary based on inputs, prompts, settings, and model updates.

You should review outputs before relying on them for publication, advertising, product listings, manufacturing, or regulatory submissions.

GenShot Studio does not guarantee legal clearance, originality, non-infringement, exclusivity, or fitness for a particular business, creative, legal, or regulatory purpose.

GenShot Studio may use third-party AI and image-generation infrastructure providers as part of service delivery.

The Service may evolve over time. We may modify, replace, suspend, or discontinue features, workflows, or integrations at any time.

We do not guarantee uninterrupted or error-free availability. Maintenance windows, outages, infrastructure events, and third-party dependencies may affect access.

Plan packaging, feature limits, and included functionality may be updated from time to time.

You may stop using the Service at any time. If you cancel a paid plan, cancellation timing and billing effects are governed by your current plan terms.

We may suspend or terminate access, in whole or in part, for breach of these Terms, non-payment, security abuse, legal risk, suspected misuse, or behavior that could harm the Service, other users, or third parties.

Paid-plan cancellation does not by itself delete your account or remove access to previously generated content. Generated outputs may remain exportable after plan cancellation as long as the account remains active.

If an account is deleted, access to associated uploads and outputs may end. Where support is contacted before deletion is completed, we may, where technically feasible, assist with export or recovery. Once deletion has been completed, restoration may not be possible.

We may retain records required for security, billing, tax, legal, or compliance purposes.

Sections that by their nature should survive termination remain in effect, including those relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis.

We disclaim warranties of any kind to the extent permitted by law, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant uninterrupted availability, error-free operation, or that outputs will satisfy every creative, legal, commercial, or compliance requirement.

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer law.

To the maximum extent permitted by applicable law, GenShot Studio will not be liable for any indirect or consequential loss arising out of or in connection with the Service.

To the maximum extent permitted by applicable law, GenShot Studio's total aggregate liability for all claims arising out of or relating to the Service will not exceed the total amount paid by you to GenShot Studio for the Service in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability for wilful misconduct, gross negligence, injury to life, body, or health, fraud, or any other liability that cannot be excluded or limited under applicable law.

To the extent permitted by applicable law, you agree to indemnify and hold harmless GenShot Studio from third-party claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from or related to:

• your User Content and submitted inputs;
• your use or misuse of the Service or generated outputs;
• your breach of these Terms;
• your infringement or violation of third-party rights; or
• any unlawful or prohibited use of the Service or outputs.

These Terms are governed by the laws of Germany, excluding conflict-of-law rules.

The competent courts in Germany shall have jurisdiction, unless mandatory consumer protection law provides otherwise.

Before filing a formal claim, each party agrees to send written notice and attempt in good faith to resolve the dispute informally for 30 days.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date shown at the top of this page.

For material changes, we will provide at least 30 days' notice, such as by email or in-product notice, before the updated Terms take effect.

Your continued use of the Service after updated Terms become effective constitutes acceptance of those updated Terms, to the extent permitted by law.
